Curaçao Island Rentals


This Rental Agreement (“Agreement”) applies to all bookings made with Curacao Island Rentals B.V. (“CIR”). By submitting a reservation request, completing any payment, or checking the agreement box during booking, the Guest acknowledges that they have read and agree to this Agreement, together with the General Terms & Conditions and House Rules, which form an integral part of this Agreement.

Guest” refers to the head tenant and all members of the travel party.

1. Property

CIR agrees to rent to the Guest the accommodation specified in the booking confirmation, including the facilities, number of bedrooms, maximum occupancy, and amenities as applicable.

2. Term & Minimum Stay

  • The rental period, including check‑in and check‑out dates, is stated in the booking confirmation.
  • Minimum stay requirement: 7 nights, unless CIR approves a shorter stay. A surcharge may apply to shorter stays depending on the accommodation and season.

3. Payments & Security Deposit

  • A 50% deposit is due within 24 hours of booking acceptance.
  • If arrival is within 60 days, 100% payment is due within 24 hours.
  • Payments may be made via bank transfer or credit card (VISA/MasterCard 3D Secure Code). Banking fees are the sender’s responsibility.
  • Access to the accommodation is granted only after full cleared payment is received.
  • A refundable security deposit of USD 500.00, or the amount specified for the accommodation, is due before or at check‑in.
  • Refunds are processed within 7 days after check‑out, minus any deductions for damages, replacements, extraordinary cleaning, lost items, open balances, and/or over‑usage of utilities.

4. Booking Modifications

  • All modification requests must be submitted in writing.
  • CIR is not obligated to accept modifications once the Agreement is in effect; acceptance is at CIR’s discretion.
  • Approved modifications are subject to availability and will be re‑priced at the current applicable rates for the new stay period and guest count.
  • CIR does not charge a modification fee.

5. Maximum Occupancy

  • The accommodation may only be occupied by the number of guests listed in the booking confirmation.
  • Additional overnight guests or day visitors beyond the confirmed number are not permitted unless approved by CIR.
  • CIR may refuse access or terminate the stay for occupancy violations in accordance with the accommodation or resort house rules.

6. Cancellation Policy

  • All cancellations must be submitted in writing.
  • The cancellation terms applicable to your accommodation are included in the booking confirmation.
  • Cancellation deadlines are based on Midnight (UTC‑4, Curaçao).
  • A USD 150.00 administration fee applies to all cancellations.
  • Guests are responsible for securing appropriate travel and cancellation insurance for their entire party.
  • CIR will issue a reminder 3 days before a payment deadline. If payment is not received by the due date, CIR may cancel the booking after 48 hours’ notice.

7. Force Majeure

CIR is not liable for delays, non‑performance, or damages resulting from circumstances beyond its control (including but not limited to natural disasters, pandemics, extreme weather, power outages, strikes, war, changes in legislation, or other force majeure events). CIR will notify the Guest within 14 days of the relevant event where possible.

8. Liability

  • CIR is not liable for theft, loss, or damage to Guest property or persons, nor for loss of enjoyment, business interruption, or other consequential damages.
  • CIR is not responsible for interruptions or defects in services provided by third parties (such as utilities or internet service providers).
  • The Guest is liable for any damage to the accommodation or its contents caused by themselves, their travel party, or third parties present with their consent.
  • The Guest agrees to indemnify and hold CIR harmless from third‑party claims arising from acts or omissions of the Guest or their invitees.
  • If the accommodation is left in an unreasonably dirty condition, additional cleaning costs may be charged.

9. Rates, Occupancy & Utilities

  • All rates are listed in USD and subject to 7% tax.
  • Standard rates are based on 2‑person occupancy; additional guests may increase the nightly rate.
  • Baby bed & high chair: Available upon request. A surcharge may apply depending on the accommodation.
  • Rates may change until the booking is confirmed.
  • Each accommodation includes a defined electricity usage allowance. Over‑usage will be charged at the applicable rate and may be deducted from the security deposit.

10. Fair Use & Prohibited Conduct

  • Guests must use the accommodation and common areas respectfully and responsibly.
  • The following are prohibited:
    • Smoking indoors
    • Burning candles
    • Causing nuisance or disturbance
    • Pets (unless explicitly allowed)
    • Commercial activity of any kind, including illegal activities
    • Subleasing or transferring the booking
  • Consequences for violations—including additional charges, penalties, or termination of the stay without refund—are determined by the accommodation or resort house rules.

11. House Rules & Maintenance

  • Guests must comply with the resort’s House Rules at all times.
  • CIR reserves the right to remove guests from the accommodation for serious or repeated violation of House Rules. No refunds will be issued.
  • Guests must allow reasonable access to CIR staff or contractors for necessary maintenance, with no right to compensation.

12. Damages, Repairs & Guest Responsibilities

  • The primary Guest is responsible for the conduct of all occupants.
  • All damages, breakages, or loss must be reported immediately to CIR.
  • Guests may not perform repairs, alterations, or modifications (including drilling holes, painting walls, moving furniture outside, etc.).
  • Extraordinary cleaning costs and replacement costs (e.g., lost keys or remotes) may be charged at cost price and deducted from the security deposit.

13. Security Deposit Handling

Unless otherwise indicated for the specific accommodation, a USD 500.00 security deposit is required before or at check‑in. Refunds will be issued within 7 days after departure, less any deductions for damages, cleaning, replacements, lost items, over‑usage of utilities, or other outstanding balances.

14. Check‑In / Check‑Out

  • Check‑in: 4:00 PM
  • Check‑out: 11:00 AM
  • A guaranteed late check‑out requires booking an additional night. Otherwise, early check‑in/late check‑out is subject to availability and may incur a surcharge.
  • Guests must remove all trash to the designated garbage area upon departure.

15. Included Services

  • Depending on the length of stay, scheduled cleaning and linen changes may be included.
  • Additional cleaning is available upon request at a surcharge.
  • One designated parking space is included per accommodation.

16. Age Requirement & Acceptance

  • Reservations may only be made by individuals 21 years of age or older.
  • CIR reserves the right to refuse any booking at its discretion.
  • The Agreement becomes binding once CIR accepts the booking and requests payment.

17. Governing Law

This Agreement is governed by and construed in accordance with the laws of Curaçao. Any disputes shall be brought before the competent courts of Curaçao, unless mandatory law dictates otherwise.

Entire Agreement

This Rental Agreement, together with the General Terms & Conditions, House Rules, and the specific details of the booking confirmation (dates, rates, property details, policy, renter name), constitutes the full and binding contract between Curacao Island Rentals B.V. and the Guest.
